This End User License Agreement (“Agreement”) is a legal agreement between you (“User”) and Scarlet Express regarding your use of our web application, delivery platform, and associated services (“Platform”).

By accessing or using the Platform, you agree to be bound by this Agreement.

1. License Grant

Scarlet Express grants you a limited, non-transferable, non-exclusive license to access and use the Platform for lawful, personal, and non-commercial cannabis delivery purposes in accordance with this Agreement and applicable law.

2. Restrictions

You may not:

• Copy, modify, distribute, or sublicense the Platform

• Use the Platform to conduct any illegal or unauthorized activity

• Attempt to reverse-engineer or interfere with platform functionality

• Permit unauthorized access to your account or data

• Use the Platform if you are under the legal cannabis age in your jurisdiction

3. Ownership

Scarlet Express retains all rights, title, and interest in the Platform, including all intellectual property. This Agreement does not transfer any ownership rights to the User.

4. Compliance with Laws

You agree to use the Platform only in jurisdictions where cannabis delivery is legal and only in full compliance with all relevant cannabis laws and regulations.

5. Termination

Scarlet Express may terminate or suspend access to the Platform at any time, without notice, for violations of this Agreement or any unlawful use.

6. Disclaimer of Warranty

The Platform is provided “as is” and “as available.” Scarlet Express disclaims all warranties, express or implied, including any warranty of merchantability, fitness for a particular purpose, or non-infringement.

7. Limitation of Liability

Scarlet Express shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform. Maximum aggregate liability shall not exceed the amount paid (if any) for accessing the Services in the past 12 months.

8. Governing Law

This Agreement is governed by the laws of the state in which Scarlet Express operates. Any legal disputes shall be resolved in courts of competent jurisdiction in that state.
